CITY OF ANTIGO
COMMON COUNCIL
APRIL 21, 2009


Common Council of the City of Antigo met for reorganization on the above date at 6:00 p.m. in the Council Chambers, City Hall, Mayor Bill Brandt presiding.

Roll Call – Present:  Alderpersons Kapusta, Darling, Kassis, Noskowiak, Zelazoski, Shinners, Cahak, Balcerzak, and Turnbull.  Absent:  None. 

Department Managers in attendance were:  Dale Soumis, Director of Administrative Services; Kaye Matucheski, Clerk-Treasurer; Robert Piskula, Street Commissioner; Eric Roller, Police Chief; Jerome Wilhelm, Inspector/ Assessor; Sarah Young, Parks, Recreation, and Cemetery Supervisor; Charley Brinkmeier, Civil Technologist/Surveyor; James Pike, Communication and Technology Supervisor; and Cynthia Taylor, Library Director.
    
Others in attendance were:  Michael Winter, City Attorney; Jeanne Jensen, Deputy Clerk-Treasurer; Lisa Haefs, Antigo Daily Journal; Rusty Mehlberg, WACD/WATK Radio; Robert Stimac, Jr.; Julie Brandt; Sam Hardin; Sarah Zelazoski; Dick Hartmann, Langlade County Community Development Corporation; Rodney Gatton; and Carol Gatton.

The Pledge of Allegiance was recited followed by a moment of silent meditation.

Mayor Brandt noted there will now be a ceremonial swearing in of elected officials.  Kaye Matucheski, City Clerk-Treasurer, administered the oath of office to Mayor Brandt and Alderpersons Kapusta, Darling, Zelazoski, Shinners, Cahak, and Turnbull.

Citizen Comments

Robert Stimac, Jr., 413 Milton Street, regarding Council Rule on procedure to address Council.  Mr. Stimac commented the constitution gives us the right to speak and rule 2 goes against that.  He feels that the rule restricts free speech and is against open government.  It is not too much of Council’s time to listen to a constituent for five minutes.

Mr. Stimac further noted his daughter is a freshman in high school.  He feels it is a dangerous situation to let kids walk down Tenth Avenue in the winter.  A safe sidewalk needs to be a priority.

Mr. Stimac stated the vandals at the playground were caught and the police need to find the kids spray painting up the business buildings in town also.  This also needs to be a priority.   

Mayor Brandt referred the sidewalk issue to the Public Works Committee and the building vandalism to the Police Chief.  

Sam Hardin, 1515 North Superior Street, commented that he was a member of Council for 13 years and that it was a very pleasant experience.  He feels the Council is very representative of the City and will keep the progressive items going that the Council has been working on for the last few years.  Mr. Hardin noted the City has already put in an application for a stimulus grant for sidewalks along Tenth Avenue.  He welcomed everyone to Council. 

There were no other individuals in attendance wishing to address Council.

NEW BUSINESS

Election of Council President

Alderperson Noskowiak moved, Alderperson Darling seconded, to nominate Alderperson Kassis for Council President.

Alderperson Noskowiak moved, Alderperson Balcerzak seconded, to close nominations and cast a unanimous vote for Alderperson Kassis for Council President.   

Ayes were:  Darling, Kassis, Noskowiak, Zelazoski, Shinners, Cahak, Balcerzak, and Turnbull.  Noes were:  Kapusta.  Carried. 

Election of an Alderperson to Serve on City Plan Commission

Alderperson Shinners moved, Alderperson Kassis seconded, to nominate Alderperson Balcerzak to serve on the City Plan Commission.

Alderperson Kapusta nominated Alderperson Shinners to serve on the City Plan Commission. 

Alderperson Darling moved, Alderperson Noskowiak seconded, to close nominations.  Carried. 

Upon tabulation of the secret ballots, Kaye Matucheski, Clerk-Treasurer, announced Alderperson Balcerzak would serve as City Plan Commission representative.  

Communications

Proposed Council Rules for 2009-2010 Term

Mayor Brandt noted that there was one typing correction from chairman to councilperson and the electronic voting wording was updated.

Alderperson Kassis moved, Alderperson Darling seconded, to approve the proposed Council Rules for 2009-2010. 

Alderperson Shinners inquired on the rule that Mr. Stimac is concerned about.  To which Mayor Brandt explained it has always been in the rules but Mayor Matousek started enforcing it.  He noted it is handled the same as Langlade County and the School Board.  Council cannot take any action on items anyway as they need to go to committee first.  The subject needs to be something on Council agenda.  It works better to be discussed at committee because those meetings are our work sessions.  

Alderperson Shinners noted that people are allowed to come to Council, sign in, and be allowed to talk if Council overrides the decision not to allow someone to talk. 

Alderperson Balcerzak noted that if citizens are unsure of what committee concerns should be addressed to, they can come see Mayor Brandt, to which Mayor Brandt stated definitely.  He also noted Council requests speakers to state their address so that after the referral is made an agenda can be sent to the individual.

Upon inquiry by Alderperson Kapusta, Mayor Brandt noted if there is something on the sign in sheet they are either allowed to address Council or the item will be referred to a committee. 

Alderperson Kassis commented Council has tried to limit this because discussion needs to take place at the committee level and not at Council meetings.  

The motion to approve the proposed Council Rules for 2009-2010 carried.   

Mayor – Appointments to Committees, Boards, and Commissions  

Alderperson Kassis moved, Alderperson Balcerzak seconded, to approve the Mayor appointments to committees, boards, and commissions.

Ayes were:  Kapusta, Darling, Kassis, Noskowiak, Zelazoski, Shinners, Cahak, Balcerzak, and Turnbull.  Noes were:  None.  Carried.   

Resolutions

Resolution No. 049-09 regarding Designation of Official Newspaper

BE IT RESOLVED by the Common Council, City of Antigo, that the Antigo Daily Journal be, and is hereby designated as the official newspaper for the ensuing year.
Alderperson Noskowiak moved, Alderperson Shinners seconded, to approve Resolution No. 049-09.  Carried. 

Resolution No. 050-09 regarding Designation of Public Depositories

BE IT RESOLVED BY THE COMMON COUNCIL, City of Antigo, that Chase Bank, M & I
  Merchants Bank (M & I Bank), Banner Banks, Citizens Bank, CoVantage Credit Union, Local Government Investment Pool, and Wisconsin Investment Trust be authorized as the designated public depositories from the City of Antigo, as identified on the attached resolutions designating public depositories.

Alderperson Kapusta moved, Alderperson Darling seconded, to approve Resolution No. 050-09.  Carried. 

MISCELLANEOUS BUSINESS

Payment of Bills

Alderperson Kassis moved, Alderperson Shinners seconded, that Block Grant Revolving Loan Fund Check Nos. 2813-2822, both inclusive, be allowed as approved by the Mayor; and the Clerk-Treasurer be directed to pay the same.

Ayes were:  Kapusta, Darling, Kassis, Noskowiak, Zelazoski, Shinners, Cahak, Balcerzak, and Turnbull.  Noes were:  None.  Carried. 
 
Any Other Business Authorized to be Considered at Said Meeting

Alderperson Kassis stated he would like to talk about strategic planning again.  Mayor Brandt referred this to the Finance, Personnel, and Legislative Committee. 

Alderperson Turnbull noted she would like a discussion regarding Council Chambers.  She would like to see more public participation and would like to start a conversation regarding chambers being more accessible.  Mayor Brandt commented that he would love to have enough participation at meetings to have to move to Volm Theater. Mayor Brandt referred this to the Finance, Personnel, and Legislative Committee.  

There was no other business to be considered.

Alderperson Kassis moved, Alderperson Noskowiak seconded, to adjourn at 6:23 p.m.  Carried.
